Terms of Use

Your use of the YourAccountCenter.com website is governed by the following Terms of Use. You may print a hard-copy of this agreement by clicking the “Print” button in your web browser.

Online Website Agreement and Authorization for Payments

The YourAccountCenter.com Web Site (the "Service") is an on-line bill viewing and payment service. The Service is under license from Emerald AR Systems, LLC ("YourAccountCenter”, "we" and "us"), an Arizona limited liability company and is subject to the terms and conditions embodied herein (collectively the “Agreement”), which you consent to by way of your acceptance of the terms using the "Access Account” button on the screen, and/or your use of the Portal. The Service provides users (“You”) to remit funds on your behalf to pay your bills owed to a YourAccountCenter biller (“Billing Entity”). You understand that the terms of this Agreement may change, with or without notice, and You are bound to any such changes. If You do not agree to be bound by the Agreement, You may not access or use the Portal or the YourAccountCenter Service. YourAccountCenter may modify this Agreement from time to time, and such modifications shall be effective immediately upon posting of the modified Agreement. By continuing to access or use the Service following such modifications, you agree to be bound by the modified Agreement. YourAccountCenter.com has no obligation to notify users of the posting of a modified Agreement.

Payment Services

By accessing the Service, you authorize YourAccountCenter.com (1) to establish and maintain your payment authorizations and (2) to process your payments according to your instructions.

Types of Payments and Payees

You may use the Service only to authorize the payment of bills owing to the Billing Entity. Payments that you authorize will be made from a bank or financial institution account (the "Transaction Account") that you designate. It is your responsibility to establish and maintain the Transaction Account and to pay all fees associated with the Transaction Account.

Timing

By providing YourAccountCenter with a payment authorization under the Service, you authorize YourAccountCenter to charge the Transaction Account and to remit funds on your behalf to pay your bills owed to Billing Entity. It is your responsibility to make timely payment authorizations, so that the funds will clear before the date on which they are due. You should submit all payment authorizations to YourAccountCenter at least two (2) business days before the actual due date for the bills. A "business day" means any day other than Saturday, Sunday, a federal holiday, or any other day on which banks in the United States are not generally open for business. You shall bear the risk and the responsibility for paying any late charges or penalties resulting from the late receipt of any payment made under the Service; provided, however that YourAccountCenter agrees to waive late charges and penalties resulting from late receipt of payment, in the event that your payment authorization was made more than (2) business days before the actual due date and the payment is late solely due to YourAccountCenter's failure to promptly process your payment authorization.

Responsibility of YourAccountCenter

YourAccountCenter will use all reasonable efforts to process all your payment authorizations promptly and properly, provided the authorizations are received by YourAccountCenter. YourAccountCenter will not be responsible for any failure to process a payment authorization that is not actually and completely received by YourAccountCenter for any reason, including user error, equipment malfunction, natural disasters or impediments, or inaccurate or incomplete information.

Bank or Financial Institution Limitations

In using the Service, you are requesting YourAccountCenter to make payments for you from your designated Transaction Account. If your bank or financial institution is unable to process a transaction (for example, there are not sufficient funds in the Transaction Account to cover the transaction, or if funds in the account are unavailable for any reason), the transaction may not be completed. There may be limits or restrictions upon the number or frequency of payments that may be made from your Transaction Account under applicable law or under the terms of your agreement with the bank or financial institution maintaining the Transaction Account. YourAccountCenter's obligations under the Service are subject to any such limits or restrictions, and YourAccountCenter has no duty to notify you of any such limits or restrictions.

Fees

A convenience fee for payment processing may be added where applicable. Any convenience fees for payment processing will be stated and must be agreed to during the payment entry process.

Your Account

You must provide accurate and complete information when you access the Service. You are responsible for the security of your passwords and for any use of your account. By providing your email address, you are 1) confirming that your email address is valid and correct, and 2) you are authorizing us to send account related correspondence such as, but not limited to, payment receipts, refund information, and new feature notifications to the provided email address. We reserve the right to refuse service, terminate accounts, remove or edit content in our sole discretion.

Your Privacy

Protecting your privacy is very important to us. Please review our Privacy Policy in order to better understand our commitment to maintaining your privacy, as well as our use and disclosure of your information.

Your Health Information

You hereby authorize the receipt, use, and disclosure of your Protected Health Information (PHI) from any health plan, physician, health care professional, hospital, clinic, laboratory, pharmacy, medical facility, or other health care provider that has provided payment, treatment, or services to you or on your behalf, by YourAccountCenter in accordance with this agreement and our Privacy Policy . You understand that the purpose of YourAccountCenter’s use and disclosure of your health information is solely to provide you with the services described in this agreement. You understand that this data may contain sensitive information relating to HIV/AIDS diagnoses, mental illness or any other mental health condition, alcohol or substance abuse, sexually transmitted diseases, pregnancy, abortion or other family planning, genetic tests and/or diseases. Unless you expressly revoke it, your authorization shall remain in effect until January 1, 2050.

Notification via Email or Text Message (SMS)

By providing email of cell phone numbers, you are giving YourAccountCenter permission to periodically email you or send you text message (SMS) notices about new bills or reminders about bills with pending due dates. Standard message rates and data charges from your carrier may apply to sending and/or receiving text messages (SMS). You may choose to enable or disable this feature at any time, but changes may take up to 48 hours to become effective. YourAccountCenter reserves the right to discontinue notifications at any time, in our sole discretion. Your Protected Health Information (PHI) will not be contained in any emails or text messages (SMS). Your PHI can only be viewed by logging into YourAccountCenter using your required information to access the Service.

Payments

Each time you initiate a transaction, you authorize us, or our Billing, to charge your credit/debit card or to initiate an automated clearing house (ACH) debit to your checking account at the specified financial institution for the specified amount on or after the scheduled date. You agree that submitting the payment constitutes an explicit authorization for us, or our Billing Entity, to complete the electronic charge/transfer. Once you have authorized the payment, you will not be able to cancel the transaction on or after the scheduled date. You acknowledge that this authorization shall remain in full force and effect until we have received written notification of its termination. By choosing to pay with an ACH, you give YourAccountCenter the right to resubmit any ACH debit you authorized that is returned for any reason, including by not limited to insufficient or uncollected funds, and to collect a $25.00 administrative fee. Such collection efforts may be completed internally or via a third-party collections agency. YourAccountCenter reserves the right to refuse to process a transaction for any reason or without reason.

Refund Policy

Refunds may be requested for payments made in excess of the total bill amount. All refund requests must be made within thirty (30) days of the erroneous payment and must be emailed to support@youraccountcenter.com. If approved, a refund will be issued within 30 days and may take the form of a credit card statement credit or a separate refund check.

Chargebacks and Payment Disputes

If a dispute or question arises about a transaction between you and YourAccountCenter please contact us first before contacting your card issuer and/or filing a dispute/chargeback with your bank. By initiating a retrieval or chargeback request with your card issuer, you are implicitly authorizing YourAccountCenter to release the necessary information to comply with the card brands’/financial institutions’ information request; in some cases, this can include your Personally Identifiable Information (PII) and Protected Health Information (PHI). As our goal is to learn about and address your concerns as quickly as possible while securely maintaining your personal information, all questions and concerns should be directed to our Customer Care line at 877-636-3588 between 10AM-4pm PST.

Intellectual Property

“YourAccountCenter.com” and all related logos, products and services described in our website are either trademarks or registered trademarks of YourAccountCenter or its Billing Entities. You may not copy, imitate or use them without YourAccountCenter’s prior written consent. In addition, all page headers, custom graphics, button icons, and scripts are service marks, trademarks, and/or trade dress of YourAccountCenter. You may not copy, imitate, or use them without our prior written consent. All right, title and interest in and to the YourAccountCenter website and any content thereon is the exclusive property of YourAccountCenter and its licensors.

Licenses and Site Access

YourAccountCenter grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of YourAccountCenter. This license does not include any resale or commercial use of this site or its contents; any derivative use of this site or its contents; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of YourAccountCenter. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of YourAccountCenter without express written consent. You may not use any meta tags or any other “hidden text” utilizing YourAccountCenter’s name or trademarks without the express written consent of YourAccountCenter. Any unauthorized use terminates the permission or license granted by YourAccountCenter.

DISCLAIMER OF WARRANTIES

YOURACCOUNTCENTER IS PROVIDING THE SERVICE "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. YOURACCOUNTCENTER DOES NOT WARRANT THAT THE SERVICE IS ERROR-FREE, OR THAT ACCESS TO AND USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

LIMITATION OF LIABILITY

IN NO EVENT SHALL YOURACCOUNTCENTER OR ANY BILLING ENTITIES BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF THE SERVICE, WHETHER INCURRED BY YOU OR ANY THIRD PARTY, EVEN IF YOURACCOUNTCENTER OR ITS BILLING ENTITIES OR SUPPLIERS HAVE BEEN ADVISED OR MAY OTHERWISE KNOW OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS PROHIBIT EXCLUSION OR LIMITATION OF LIABILITY FOR IMPLIED WARRANTIES OR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Applicable Law

By using the Service, you agree that the laws of the state of Arizona, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you YourAccountCenter. By using this site, you consent to exclusive jurisdiction and venue of Maricopa County, Arizona. Any dispute relating to your use of the Service shall be adjudicated in such jurisdiction.

Modification

We may amend our Terms of Use at any time by posting a revised version on our website. The revised version will be effective at the time we post it, unless otherwise indicated. If the modified Terms of Use are not acceptable to you, your only recourse is to cease using our site.
